Another Call from the Australian Government's Department of Home Affairs for Visitors to Be Honest About Their Intentions.


As of July 1, 2024, the Department has expanded the list of visas that prevent holders from applying for a student visa while in Australia. The updated list now includes the Tourist Visa (Subclass 600), Graduate Visa (Subclass 485), and Crew Visa (Subclass 988). Any student visa (Subclass 500) application submitted by a holder of one of these visas while in Australia will be considered invalid.

This tightening of student visa rules is a response to the widespread misuse of temporary stay conditions in Australia. A common type of visa misuse involved individuals applying for student visas solely as a means to extend their stay in the country.

We often receive inquiries such as:"I obtained a tourist visa and arrived in Australia. What options do I have to stay?"

There is certainly nothing wrong with falling in love with Australia and wanting to stay. However, when applying for a tourist visa, you assured the Department that you would return home because of commitments such as work, children, property, and other obligations—didn't you? This means that if your true intention was to stay, you were not entirely honest when applying for your temporary visa.

Therefore, if you are considering staying in Australia or even exploring such a possibility, we urge you to be honest about your intentions from the very beginning—during your consultation with an agent and, of course, before applying for a visa.
