We are often asked: CAN OUR AGENCY GUARANTEE A VISA APPROVAL?

The answer is: No. Australian law explicitly prohibits any migration agent or company from guaranteeing a visa outcome. If someone promises you a “100% guaranteed visa,” be cautious — this is almost certainly a scam.

Under the Migration Agents Code of Conduct (Schedule 2, Migration Agents Regulations 1998):

• Clause 2.1A (Honesty): A migration agent must act honestly in all dealings.

• Clause 2.9: An agent must not guarantee the outcome of a visa application.

• Clause 2.10: An agent must explain that all visa decisions are made exclusively by the Department of Home Affairs, not by the agent.

• Clause 5.2: Agents are prohibited from advertising or offering any guaranteed outcome.

A licensed migration agent will always act in the client’s best interests because:

• negative visa outcomes impact the agent’s professional standing,

• dissatisfied clients may lodge a complaint with OMARA, which can trigger a formal investigation,

• multiple complaints or poor conduct may lead to suspension or cancellation of the agent’s licence.

Before entering into a Service Agreement, our specialists always assess each client’s circumstances carefully. If the chances of a positive outcome are low or nonexistent, we will communicate this clearly, honestly, and transparently — as required by Australian law.
